Song Print Terms of Use
1. ACCEPTANCE OF TERMS
Welcome to Song Print™, a service of PrintandPraise.com™ (P&P). P&P provides this service to you, subject to the following Terms of Use ("TOU"), which P&P may update from time to time. You can review the most current version of the TOU at any time on this page. P&P also may offer other web-based services from time to time that are governed by different Terms of Use. The following TOU apply only to Song Print™.
2. DESCRIPTION OF SERVICE
Song Print™ currently allows users to download certain editions of some songs which OCP owns or has the authority to sub-license. P&P shall have the right to change or discontinue any aspect of Song Print™ at any time. For example, P&P may change the price, content, hours of availability or equipment needed for access or use.
3. CONTENT AND USE
The contents of Song Print™ are intended for noncommercial use. Song Print™ contents include, but are not limited to, text/melody editions (hereafter "Content"). These contents are protected by copyright and are owned or controlled by P&P or the party credited as the provider of the Content. Purchasing access to Song Print™ does not, by itself, give you the right to download, reprint, photocopy, or otherwise reproduce and distribute the Content, except for content in the public domain. You agree to abide by all copyright notices, information and restrictions contained in any Content accessed through Song Print™. To comply with copyright law you must acquire permission to use the Content from the appropriate copyright administrators(s). Permission is usually granted in the form of a license. You are responsible for all license fees and requirements. If you do not have the appropriate license, visit licensingonline.org to obtain one.
4. GUIDE TO COPYRIGHT
A copyright is intellectual property that belongs to a copyright holder. Only the copyright holder or administrator of that copyright has the legal right to use or to grant permission to use the copyrighted material.
Before using copyrighted material you must obtain permission from the copyright holder or administrator. You can determine this source from the copyright information that appears below the work, or in some cases in an acknowledgements section of the resource. It includes the copyright symbol ©, year, and the name of the copyright holder and/or administrator.
Important License Specifics:
- Some licenses are purchased for reprint of a particular number of copies. In this case, if you wish to make further copies you must obtain a new license.
- Other licenses are time-based (like the LicenSingOnline license). In this case, copies may be made and used only during the period in which the license is in force. When the license expires you are required to destroy any materials reproduced under the terms of the license.
- Licenses are issued for words and melody line only unless otherwise stated.
- Music and text may not be changed from the copyrighted material.
- The title and name(s) of the composer(s) along with the appropriate copyright notice must appear on each copy of each song.
- A license is issued with the understanding that it may be used only by the church or individual that has purchased it. Reprints may not be sold.
- Churches, schools, and non-profit organizations are not exempt from copyright law.
5. ACCESSING SONG PRINT/OCP ACCOUNT DATA
To use Song Print™, you need a valid email address and password. In order to purchase a subscription, you need to provide valid information to establish an OCP account. You agree to (a) provide true, accurate, current and complete information about yourself ("Account Data") and (b) maintain and promptly update your user profile.
6. OCP ACCOUNT AND SECURITY
Each time you access Song Print™ you must enter your email and password associated with the Account Data. You are responsible for maintaining the confidentiality of your email/password, and are fully responsible for all activities that occur using your email/password. You agree to immediately notify OCP of any unauthorized use of your email or password or any other breach of security. OCP cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 6.
7. PRIVACY POLICY
Account Data and personal information are subject to the Privacy Policy of www.printandpriase.com. For more information, see our full Privacy Policy.
8. COMMUNICATIONS BETWEEN P&P AND SUBSCRIBERS
P&P reserves the right to send electronic mail to you regarding Song Print™ service advisories as necessary to support your ability to use the product. You will be given the option to receive marketing messages such as notices concerning other products, the introduction of new features, special promotions, and surveys. All correspondence regarding Song Print™ should be sent to support@printandpraise.com.
9. FINANCIAL RESPONSIBILITY
You agree not to assign, transfer or sublicense your rights as a subscriber to Song Print™. If you have purchased as a member of a church or institution, you agree not to assign, transfer or sublicense your rights as a subscriber to Song Print™ to anyone outside of your church or institution. You agree to be financially responsible for all usage or activity on your Song Print™ account.
10. NO RESALE OF SERVICE
You agree not to sell, resell or offer for any commercial purposes any portion of Song Print™, use of Song Print™ or access to Song Print™.
11. EQUIPMENT
You shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of Song Print™ and all charges related thereto.
12. MONITORING
P&P shall have the right, but not the obligation, to monitor the content of Song Print™. P&P shall have the sole right to edit, or remove any material on the website.
13. CHANGED TERMS
P&P shall have the right to change or modify these Terms of Use at any time. Such changes or additions shall be effective immediately upon posting on Song Print™ or when you obtain actual knowledge of them. Any use of Song Print™ after such notice shall be deemed to constitute your acceptance of such changes and/or additions.
14. TERMINATION
You may terminate your account at any time by sending email to support@printandpraise.com. Upon termination, you will receive confirmation via email within one (1) business day. You are responsible for all charges incurred up to the time the account is deactivated. Termination on your part will result in the forfeiture of your subscription payment.
P&P may, in its sole discretion, terminate or suspend your access to all or part of Song Print™ for any reason.
If you terminate your subscription, or if your subscription lapses, you agree to delete any and all Song Print™ information from your hard drive. Upon termination, you will have not permission to use Song Print™ material.
15. GOVERNING LAWS AND JURISDICTION
These Terms of Use shall be governed by and interpreted according to the laws of the State of Oregon. You consent to jurisdiction in the State of Oregon, and you agree that Multnomah County, Oregon, shall be the venue for any action brought under these Terms of Use.
